In this article, I examine whether the concept of testimony can be used in order to clarify the epistemological value of literary fiction. It seems that it cannot: a testimony can be wrong while it makes no sense to say that a literary fiction can be wrong. However, in the wake of a hermeneutic philosophy, the fictional story has often been qualified as a testimony of an experience, even in cases which are not merely autobiographical. I try to unravel this (...) paradoxical connection between literary fiction and testimony. Starting from an examination of Kafka’s short story “Metamorphosis”, I intend to articulate the distinction between literary fiction and testimony, on the one hand and on the other, to understand the importance of the perspective of the witness in literary fiction. From the 1990s until just before his death, the legendary art critic and philosopher Arthur C. Danto carried out extended conversations about contemporary art with the prominent Italian critic Demetrio Paparoni. In dieser Monographie wird, beginnend mit einem biographischen und zeitgeschichtlichen Grundriss, zum ersten Mal das umfangreiche strafrechtliche, rechtsphilosophische und philosophische Gesamtwerk Arthur Baumgartens dargestellt. Baumgarten war im Jahr seiner bei Franz v. Liszt verteidigten Dissertation nach Genf berufen worden und lehrte in Köln, Basel, Frankfurt/M. und Berlin. Von der dreiteiligen "Wissenschaft vom Recht" urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die (...) stärkste Wirkung aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. Die Erfahrung von Faschismus und Krieg führte ihn in der Mitte der vierziger Jahre zu sozialistischen Überzeugungen und Erwartungen und zur Marxschen sozialwissenschaftlichen Methode, so dass er, nach Frankfurt nicht zurückberufen, gleich anderen antifaschistischen Intellektuellen in die Ostzone und spätere DDR zog. Gerd Irrlitz behandelt die Hauptwerke und die marxistisch orientierten Texte Baumgartens – wie überhaupt die sozialliberale und die späte sozialistische Periode – nicht als Gegensätze, sondern als aufeinander bezogene und einander bedingende Konzepte, überzeugt, dass das Werk des Rechtsphilosophen unterm Erfordernis der Erneuerung des sozialen Liberalismus in der hochindustriellen Zivilisation neue Aktualität gewinnen kann. Este artigo procura investigar um encontro bastante curioso de tradições. Neste caso em particular, sobre como uma paráfrase da obra de Plotino, de autoria atribuída a Aristóteles, poderia ter influenciado na elaboração de um esquema argumentativo que, aparentemente, visava utilizar a Herança grega recebida pelos árabes no século VI, em questões inerentes ao contexto de disputa intelectual do Islã nascente. Mais especificamente, nosso trabalho se aprofunda em algumas relações que se pode levantar entre a obra Teologia de Aristóteles, uma paráfrase (...) das Enéadas de Plotino que circulou entre os árabes do período, e a Filosofia Primeira de Al-Kindi, famosa obra inacabada, cuja primeira parte (texto que nos chegou), se destina a apontar como a investigação dos fundamentos da natureza leva a compreensão do que ele chama de "Um Verdadeiro", o princípio que sustenta todo o Universo como seu fundamento criador. Embora inacabada, a primeira parte desta obra de Al-Kindi já indica sua inclinação em utilizar elementos da Teologia de Aristóteles no sentido de elaborar o que podemos chamar de uma prova da existência de Deus. Christian Heinrich Arthur Drews (1865 - 1935) war ein deutscher Philosoph, Schriftsteller und wichtiger Vertreter des deutschen Monismus. Während seiner Laufbahn schrieb er über die Geschichte der Philosophie, Religionen und Mythologie. Er provoziert oft Streit wegen seiner unorthodoxen Ideen über Religion und teilweise wegen seiner Angriffe auf Nietzsche und seiner leidenschaftlichen Unterstützung von Wagner. Drews gehört zu den bekanntesten deutschen Bestreitern der Existenz eines historischen Jesus. Er faßt das Problem der Religion als ein wesentlich methaphysisches auf und vertritt den (...) Standpunkt des Pantheismus gegenüber dem Theismus der bestehenden Religionen. Das vorliegende Buch, das Drews als eine philosophische Untersuchung über das Wesen der Religion untertitelt, ist sein systematisches Hauptwerk, das sich besonders gegen die herrschende Richtung der protestantischen Theologie wendet. Diese verwirft das christliche Dogma und etabliert eine historisch-hermeneutische Christentumwissenschaft, in der Jesus zum Prototyp der Individualität erhoben wird. Er zeigt, daß eine Weiterentwicklung der Religion und eine Gesundung der religiösen Zustände nicht durch ein Zurückschrauben der bisherigen Entwicklung zu ihrem Ausgangspunkt, sondern durch Fortbildung der in jenen enthaltenen Keime aus dem innersten Wesen der Religion heraus möglich ist.
